Hi Adam, sure I will give regular updates but I have the feeling it’s going to take a while, since it’s a big company and the communication so far has been slow, but productive nonetheless.

Every case depends on the details but IMO there are certainly some things you can and can’t do. Others may have different views.

Your idea needs to pass the novelty test, that means it has to be significantly different from the previous patent. There is also something called a new use patent: you can have the same product but it is used in a new, novel way. I would recommend sending the prototype asap, don’t worry about an NDA as you’ve already filed a PPA. Save your money for a licensing attorney when they make the first offer.

Can someone tell me if you can patent an invention that is being made by someone else but that doesn’t have a patent itself? If so, is there a “rule of thumb” for altering the product enough to allow for a patent?

It’s a long and costly process. We did all the patents to prevent the copy from our competitor and it works well.
The most important thing is the writing part from the lawyer (make sure to hire a good patent lawyer), which stops any design similar to the patent. We and our competitors always search the patent for the design to avoid the lawsuits.
